A. General. The Professor Garfield Foundation, Inc. ("PGF") is a non-profit, 501(c)(3) corporation, and is the operator of this site, ProfessorGarfield.org. We at "PGF" are determined to ensure that visitors, customers and friends of professorgarfield.org will have a fun experience while visiting this Web site, without sacrificing their peace of mind as to the protection of their identity and other personal information. This policy statement tells you how we collect information on you, how it's used, and the steps we are taking to protect it from any unauthorized use.
A. General.This policy covers how PGF treats personal information that PGF collects and receives, including information related to your past use of PGF. Personal information is information about you that is personally identifiable like your name, address, e-mail address, or phone number, and that is not otherwise publicly available. For a child under 13 any information which would allow contact with the child would be considered personally identifiable information.
B. Companies Not Controlled.This policy does not apply to the practices of companies that PGF does not own or control, or to people that PGF does not employ or manage.
C. Links to Other Sites. This site contains links to other sites that are not owned or controlled by PGF. Please be aware that PGF is not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every Web site that you visit.
3. CHILDREN'S ONLINE PRIVACY
A. Limited Information Sought.Because many visitors to this site are children, we take the utmost care to make certain that our content is appropriate for kids of all ages. We allow children to initiate registration by providing us with their first name, gender, date of birth, grade, screen name, password, challenge question and answer. We limit the collection of personal information from any child to that of the parent email. We do not ask children to disclose their personal information of any kind without first obtaining verifiable parental consent through our partner Privacy Vaults Online, Inc. dba PRIVO. Children will need to obtain permission from a parent or guardian before contacting PGF in any regard, especially before entering any personal information on our website or requesting information.
B. COPPA.To enable families of children and their teachers to maximize the benefits they receive from our services, we ask that children be registered as PGF members. Registered members are able to participate in some activities including, but not limited: saving content from the site; participating in online games, applications, sweepstakes and contests, subject to official rules for each sweepstakes or contest; competing with members for high scores rankings; having their original content submission showcased along with their screen name; connecting with other members, posting messages along with their screen name; receiving an online or print newsletter from PGF; earning points and redeeming points for merchandise, and receiving communications and recognition from PGF when they check into the site.
1. Personally identifiable offline contact information will not be collected without appropriate prior consent from a parent or teacher.
2. Personal online contact information will not be solicited and collected without (i) appropriate prior consent from a parent or teacher, or (ii) parental notification, which will include an opportunity for the parent to prevent use of the information and the child's participation in the activity.
3. When consent is gained through email notification to a parent (which provides for a parental to opt out), a child’s information will only be used to (i) allow the child to authenticate to PGF for the purpose of providing limited access to the features of the site; and (ii) to allow for account administration including assistance with forgotten password.
4. Other than what is stated in Section 3. above, without appropriate prior consent from a parent or teacher, a child’s information will only be used to (i) respond directly to the child's email comment or request for information, (ii) to protect the security or integrity of PGF; (iii) to respond to judicial or other legal process; and (iv) to the extent permitted by law, to provide information to law enforcement agencies or for an investigation on a matter related to public safety, and will not be used for any other purposes.
5. PGF will not entice any child or adult, regardless of their age, to divulge more personal information than is needed to use the site or participate in any online activity by offering any special game, prize, incentive or other similar activity.
4. INFORMATION COLLECTION AND USE
A. We do not share personal information with third parties, except when necessary to complete certain activities as noted below.
PGF does not rent, sell, share personal information or disclose to third parties personally identifiable information which parents or teachers provide, except from time to time, we may transfer, disclose or share such information with third parties who may be engaged by us specifically to handle and deliver certain online activities (e.g. administering or providing online games and applications, contests and sweepstakes or fulfillment of prizes, premiums, or merchandise). Such third parties have access only to the personal information needed to perform their functions, but may not use it for other purposes.
We use our members’ information for our internal purposes to maximize the benefits PGF provides in terms of determining eligibility for any members-only sweepstakes, contests, and reward programs; accumulation points to each member’s personal account; and maximizing the educational experience for members.
We sometimes use non-personally identifiable information that we collect to improve the design and content of our site and to enable us to personalize your interaction with our site and make the most of your overall Internet experience. We also may use this information in the aggregate to analyze site usage.
We will disclose information we maintain when required to do so by law, for example, in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency’s request.
The Professor Garfield Foundation reserves the right to transfer personally identifiable information to a not-for-profit foundation with a children’s literacy mission in the event of a change of ownership of PGF to an organization of that nature. Such a transfer of data would be necessary to enable the new owner of PGF to facilitate log-on for existing PGF members and to fulfill membership benefits.
In the event of a material change in this policy by a new owner of PGF, a notification to parents and consent to the new policy will be required.
You may opt out of your child’s membership at ANY time, by logging into Manage Consent for your child with your parent user name and password, and selecting Opt-Out for PGF Membership. This will disable PGF access to your account details and will disable your account credentials working at PGF. See parental review of information in Section 9. below. If you have any questions regarding the process for deleting you or your child’s personally identifiable information, you can contact PRIVO at the details provided below.
5. PGF's USE OF 'COOKIES'
B. Cookies. To enable many of the features available on our Web site, we may assign cookies to your Internet browser. This unique identification number automatically identifies your browser (but not you) to our computers whenever you interact with one of our Internet domain names.
6. CONFIDENTIALITY AND SECURITY
A. Limited Access to Information. We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information in order to do their jobs
B. Security and Limitations. In certain areas PGF uses industry-standard SSL-encryption to protect data transmissions. PGF follows generally accepted industry standards to protect the personal information submitted to us; however, not method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we can not guarantee its absolute security.
A. Updates to the Policy.PGF may update this policy. We encourage you to periodically return to review our Privacy Policies. If we make material changes to how we collect and use Personal Information from children under age 13, we will notify parents by email in order to obtain verifiable parental consent for the new uses of the child’s Personal Information.
